1. General information
In accordance with Article 10 of Spanish Law 34/2002 of 11 July on information society services and electronic commerce (LSSI-CE), this legal notice identifies the owner of the website https://dudoctor.com (hereinafter “DuDoctor” or “the Provider”) and sets out the terms governing access to and use of the site. The Provider’s identification details are shown in the “Service provider” block at the top of this page.
2. Activity and regulated profession
DuDoctor is an online, written, remote medical consultation service. The clinical assessment of every consultation is always carried out by doctors holding an official degree in Medicine, registered with a medical association and licensed to practise, who act with clinical autonomy and independence.
- Regulated profession: doctor. The service is provided by doctors registered with a medical association in Spain or in another European Union Member State, whose name and registration number are shown to the patient in each consultation.
- Professional body: the Official College of Physicians (Colegio Oficial de Médicos) with which each doctor is registered.
- Applicable professional rules: Spanish Law 44/2003 on the regulation of healthcare professions; Law 41/2002 on patient autonomy; and the Code of Medical Ethics of the Spanish Medical Association, available on the website of the General Council of Official Medical Associations (www.cgcom.es).
- Professional liability insurance: the doctors who handle consultations hold the liability insurance, bond or other financial guarantee required by Article 46 of Spanish Law 44/2003.
DuDoctor is not an emergency service. If you have any serious symptom, go to the nearest emergency department or call 112.
3. Terms of use of the website
Access to the public part of the site is free of charge. To purchase a consultation you must be over 18, create an account and accept the Terms and conditions. When using the site you agree to:
- provide truthful, complete and up-to-date information, especially in the clinical questionnaires;
- not impersonate anyone or consult on behalf of a third party;
- not use the site for unlawful purposes, introduce malicious code, or attempt to access restricted areas or other users’ data;
- keep your login credentials confidential.
The Provider may suspend or cancel the access of anyone who breaches these terms, without prejudice to any legal action that may be appropriate.
4. Informational content
The educational content on the site (treatment descriptions, FAQs, articles) is for general information only. It is not a diagnosis and does not replace an individual assessment by a doctor. The mention of a treatment does not mean it will be prescribed: prescribing is always a clinical decision taken after reviewing each case. The site does not contain advertising of prescription-only medicines aimed at the public.
5. Intellectual and industrial property
The design, code, texts, clinical questionnaires, images, logos and the “DuDoctor” brand belong to the Provider or are used under licence from their owners. Their reproduction, distribution, public communication or transformation is prohibited without express written authorisation, except for the viewing and downloading needed for personal use of the service.
6. Liability
The Provider takes reasonable measures to keep the site running continuously and securely, but cannot guarantee that it will be entirely free of interruptions or technical errors. The Provider is not liable for damage arising from use of the site contrary to these terms, from false or incomplete information supplied by the user, or from the content of linked third-party sites, which are visited at the visitor’s own responsibility. If you become aware of an unlawful link or content, you can report it to hello@dudoctor.com so that it can be removed.
7. Data protection and cookies
The processing of personal data is described in the Privacy policy and the use of cookies and similar technologies in the Cookie policy.
8. Governing law and jurisdiction
This legal notice is governed by Spanish law. Where the user is a consumer, the courts of the user’s place of residence shall have jurisdiction. For any complaint you can use the channel described on the Complaints page.
